LiveRem Limited is a New Zealand company (8739432). In this Privacy Policy, all references to we, our or us are references to LiveRem Limited (LiveRem) or its affiliates.

We are committed to maintaining the privacy of the information of our subscribers and other users of our products and services.

In the course of our business dealings with our subscribers and other users of our LiveRem subscription service (Service), we may collect, use, disclose, and hold information about identified or identifiable persons (Personal Information), as well as other business or technical data.  

This Privacy Policy describes how we collect, use, store and distribute Personal Information and other data, and describes the purposes for which we may use, disclose or hold such Personal Information and other data. 

What Personal Information and data do we collect?

We may collect the following information from our subscribers and users in relation to the Service:

  1. We will collect personal details from users and subscribers during the course of their establishing and maintaining subscriber or user accounts or profiles with us via the Service, such as the person’s name, user name, passwords, address, email address, phone numbers, and credit card and payment details. In the case of subscribers, we may also collect such details about the subscriber’s nominated users.

  2. We will collect information from a subscriber about the subscriber’s employees and personnel when our data interface connects our own systems to that subscriber’s payroll and/or HR systems, and in the course of maintaining that connection. The information we typically collect will include some or all of the following employee and personnel details: names, contact details and locations, ages, genders, roles and job titles, periods of service (start and finish dates), remuneration levels and payments made. This information is collectively referred to in this Privacy Policy as Remuneration Data.

  3. We will collect other data that is inputted or uploaded by users into the Service. This may include information about a subscriber’s nominated users that is inputted into the Service by another nominated user of a subscriber as part of their administrator role.

  4. We will collect data related to the use of the Service by users, including details of the pages visited, the reports generated and the data accessed.

  5. We may collect other Personal Information and data during the course or as a result of our relationship with any subscriber or user, including where necessary to enable us to provide products and services to that subscriber or user or to respond to requests for further information.  

How we use Personal Information and other data

We will use, disclose and hold Personal Information and data collected by us for the following purposes:

  1. to enable us to operate the Service for the benefit of subscribers and their registered users;

  2. to establish and maintain any subscriber or user account held with us;

  3. to complete sales transactions, including billing, credit card processing, payment, receipt, credit check and verification services; 

  4. to respond to subscriber or user requests for additional information or support;

  5. to provide any after-sales service required by any subscriber or user;

  6. to maintain our records;

  7. to provide technical support and administration services in relation to the Service;

  8. to keep subscribers and users informed about products, services, events, promotions or any other marketing activities, but only to the extent permissible under applicable laws, and subject to any other restrictions contained in this Privacy Policy;

  9. for product development or research purposes; and

  10. to evaluate customer satisfaction and the performance of marketing activities. 

Cookies 

Our Service may use cookies (small text files that are placed on computers, devices or browsers used to access websites, apps or other internet content) or other software to remember information about a user’s personal preferences and user settings for the Service, to analyse Service traffic and trends, and to generally understand the behaviours and interests of people who use the Service.

Such cookies or software will only use information about a user’s personal preferences and user settings so that the Service will remember their details next time they visit.  We may use, disclose or sell other data collected by us from such cookies or software for other purposes, but only on an aggregated basis and in a way that ensures that no individual is able to be identified from such information.  

Users may be able to change the settings on the device that they use to access the Service in order to reject or limit the use of such cookies or software, but this may reduce the functionality of the Service.

Statistical data that we collect 

During a person’s use of the Service we may collect statistical data about their use, such as the date, time and length of their use, the areas or pages of the Service that they access, and information about the device they are using to access the Service. This information may be collected by software operating on the Service, or by third party service providers on our behalf.  

We may use and disclose such statistical data for the following purposes:

  1. to measure the effectiveness of any services or features provided via the Service;

  2. to identify user behaviour and user trends on the Service; 

  3. to maintain and optimise the technical performance, operation and security of any products or services provided by us; and

  4. to assist in resource planning.

We may disclose or sell such statistical data to others for any purpose, but only on an aggregated basis and in a way that ensures that no individual is able to be identified from such data.  

Remuneration Data

The Service relies on the ongoing provision by subscribers of real-time data about their payroll and remuneration levels and practices. This Remuneration Data is collected from the payroll and/or HR systems of subscribers using our data interface, and is then utilised by us in the data and reports we provide via the Service.

As a result, Remuneration Data collected from subscribers will be available to other subscribers and the nominated users, but only in a way that ensures no individual is able to be identified from such Remuneration Data. We also take steps to ensure that the Remuneration Data accessible to users of the Service does not identify the particular subscriber from whom that Remuneration Data was obtained.

User data

We may disclose information about users of the Service and their activities in the following circumstances:

  1. to our service providers to enable us to provide the Service to users and subscribers. These service providers may include IT service providers and cloud service or hosting providers;

  2. we may disclose to any subscriber to the Service details of the activities of its registered users on the Service, including details of any login activity, content accessed, reports generated and pages visited;

  3. to the extent necessary to enforce our rights and remedies under our LiveRem Terms and Conditions of Service;

  4. where otherwise expressly permitted under this Privacy Policy to do so; and

  5. where required by law to make such disclosure (for example, by law enforcement authorities).

We may use, sell or disclose any of the data about our subscribers and users of the Service that we collect (such as high level data about the geographical locations of our users or customers) for any purpose other than those purposes expressly permitted under this Privacy Policy, but only on an aggregated basis and in a way that ensures that no individual is able to be identified from such data.  

Marketing

We may use Personal Information and other data collected by us or via the Service to send or email to subscribers or users marketing or promotional information about our services or products, or the services or products of other companies (Direct Marketing Information), but only if they have expressly given us permission to do so.   

If you have given us permission to send to you Direct Marketing Information, and you later decide that you do not want us to send you any further Direct Marketing Information, you can contact us at any time to request that we stop sending you such information.  You can either contact our Privacy Officer (see the details at the end of this Privacy Policy) or use the “Unsubscribe” facility at the bottom of any Direct Marketing Information email or communication that we send you.

We will not sell to direct marketers the Personal Information or other data of subscribers or users unless they have expressly given us permission to do so. 

Business acquisition

We may transfer a subscriber’s or user’s Personal Information and other data to another entity in connection with a sale of our business or assets, or a merger or consolidation or restructuring of our business or company, or any other transaction in which a third party acquires ownership of any rights in the Service. 

If we transfer any of such Personal Information and other data in such circumstances, we will ensure that such Personal Information and other data remain protected and that the recipient of that Personal Information and other data agrees to be bound by privacy practices and obligations that are consistent with our own under this Policy.

Disclosure of information to third-parties

We will not use or disclose to third parties the Personal Information and other data of our subscribers or users, except:

  1. to the extent reasonably necessary to achieve any of the purposes described in this Privacy Policy; or

  2. where we reasonably believe that such use or disclosure is required or expressly permitted under any applicable law.

Holding Personal Information

We will not hold the Personal Information and other data of our subscribers or users for longer than is reasonably required for the purposes for which we may lawfully use that Personal Information or data. 

Security

We will use all reasonable endeavours to effect and maintain adequate security measures to safeguard the Personal Information and other data of our subscribers or users that we hold from loss or unauthorised access, use, modification or disclosure.  

Transfer of Information 

We may transfer the Personal Information or data described in this Privacy Policy to or from other countries where necessary to enable us to operate the Service, or otherwise where necessary to fulfil any of the purposes for which we are entitled to use or disclose Personal Information or data under this Privacy Policy.

If we transfer outside New Zealand the Personal Information of any New Zealand-based person, we will ensure that appropriate safeguards are in place with the recipient of that Personal Information, as prescribed by the Privacy Act 2020 (NZ), before we transfer that Personal Information.

Use of third-party websites

If you access any third-party websites via a link from the Service, you will leave the Service. By accessing these links you are not covered by the policies relating to the Service. We are not responsible for the content of any third-party websites, or their use of your Personal Information or other data.

Other privacy or security practices 

We have no control over the privacy or security practices of any third parties that you choose to share your Personal Information or data with, whether via the Service or otherwise. In particular, we cannot control what such persons may do with the information you share with them. You should ensure that all persons you share Personal Information or other valuable data with have appropriate privacy and security practices in place that protect your Personal Information or data from misuse and unauthorised disclosure.

Your rights to access and correct Personal Information

Where we hold Personal Information or other data about you, you have a right to access or request that we correct that Personal Information or data in accordance with applicable laws.  If you want to access or request a correction of your Personal Information or data, please contact our Privacy Officer (see below) and he/she will tell you how to make a request and if any charges will apply.

Amendments to the Privacy Policy

We may amend this Privacy Policy from time to time. Any such amendments will be effective immediately, unless we state otherwise.  We will take reasonable steps to notify subscribers and users of any such amendments.

Your continued use of the Service after any such notice will constitute your acceptance of any amendments or revisions to this Privacy Policy.
